MY HANGERS – GENERAL TERMS AND CONDITIONS

1. Scope of Application
1.1. These general terms and conditions ("Terms and Conditions") apply to the provision of services ("Services," cf. Section 2) by
My Hangers

("My Hangers") to individuals (the "Guest") who use My Hangers' system for digital cloakroom services.
1.2. All Services are provided in accordance with applicable legislation and these Terms and Conditions.
1.3. By registering or using My Hangers' Services, the Guest agrees to be bound by these Terms and Conditions, thereby forming a binding agreement (the "Agreement") between My Hangers and the Guest.
1.4. If the Guest allows or otherwise makes their digital coat-check ticket available to a third party, the Guest is fully responsible for that third party's use, including any payment obligations.
2. Definitions
2.1. In these Terms and Conditions, the following definitions apply:
"My Hangers System": The electronic/digital system offered by My Hangers for modern cloakroom management.
"Guest": The end user who uses the My Hangers System.
"Customer" or "Venue": A partner (e.g., nightclub, bar, music venue) that uses the My Hangers System for their cloakroom.
"Services": Any functionality and service My Hangers provides to the Guest, including digital check-in and retrieval of cloakroom items, payment, notifications, web app, mobile app, etc.
"Website": The official My Hangers website, https://myhangers.dk.
"App": Any application developed and made available by My Hangers, e.g., a mobile or web app.
3. General Conditions for the Services
3.1. General
3.1.1. My Hangers provides a digital cloakroom system that allows the Guest to receive and store their coat-check ticket on their smartphone or other device when visiting a Venue that uses the My Hangers System.
3.2. Access to the Services and Registration
3.2.1. To use the Services, the Guest must be registered with My Hangers. Registration typically occurs by scanning a QR code or NFC tag on a My Hangers hanger or by otherwise interacting with the system.
3.2.2. By registering (e.g., via SMS, app, or web app), the Guest consents to My Hangers storing the Guest's phone number or other necessary data for as long as is relevant for the provision of the Services.
3.2.3. The Guest may voluntarily enter their name or other information to enhance security when retrieving items. By entering such information, the Guest agrees that My Hangers may store these details as long as necessary.
3.2.4. After registration is complete, the Guest receives a digital coat-check ticket (e.g., via SMS or within the app). The Guest can then choose to pay digitally (e.g., via Stripe, MobilePay, Apple Pay, Google Pay, etc.), if the Venue offers this option, or pay in cash or by card at the cloakroom if available.
3.2.5. If the Guest shares the ticket with a third party, the Guest bears full responsibility for any consequences thereof, including loss or incorrect retrieval of items.
3.2.6. Certain features (e.g., location-based services or push notifications) require the Guest to enable GPS and/or notifications on their device.
3.3. Guest's Obligations and Responsibilities
3.3.1. The Guest is responsible for the accuracy of information provided to My Hangers.
3.3.2. The Guest is responsible for storing the digital ticket securely and must not share it with unauthorized persons.
3.3.3. The Guest must immediately notify My Hangers (via info@myhangers.dk) if the Guest discovers:so that My Hangers can take appropriate measures (e.g., blocking or updating information). 3.3.4. The Guest is responsible for ensuring that their mobile phone (or other device) is functional, compatible with the My Hangers System, and updated, including if an app is used.
4. Prices and Fees
4.1. Cloakroom prices are usually set by each Venue. Any fees charged by My Hangers will be clearly stated before the Guest completes payment.
4.2. All stated amounts are in Danish kroner (DKK), unless otherwise specified.
5. Payment Terms
5.1. As a rule, payments are made via My Hangers' integrated payment solution (e.g., Stripe, MobilePay, Apple Pay, Google Pay). The Guest chooses the preferred payment method in the process.
5.2. My Hangers does not charge a separate transaction fee unless otherwise stated.
5.3. Some Venues may allow the Guest to pay in cash or by card at the cloakroom.
5.4. Once payment is completed (if required for retrieval), the Guest can collect their checked items at the Venue.
6. Access to the My Hangers System and Intellectual Property
6.1. My Hangers continuously develops and updates the My Hangers System, which may result in updates, changes, or temporary downtime.
6.2. My Hangers strives for high availability, but system errors and maintenance may cause interruptions. The Guest acknowledges that software errors and unforeseen service disruptions may occur.
6.3. All copyrights and other intellectual property rights to the My Hangers System (including source code, databases, trademarks, etc.) belong to My Hangers or its licensors. The Guest does not acquire any usage rights beyond what is necessary to use the Services for personal purposes. It is not permitted to copy, distribute, modify, or attempt to reverse-engineer My Hangers' software.
7. My Hangers' Liability
7.1. Liability for Cloakroom Items
My Hangers only administers the digital aspect of the ticket. Physical storage of items is handled by the Venue. My Hangers cannot be held responsible for loss, theft, or damage to the Guest's property in the cloakroom.
7.2. Other Limitations
My Hangers is not liable for any damage or loss arising from:
a) The Guest's own mistakes or negligence (e.g., incorrect information, sharing the ticket with a third party).
b) Failure to comply with the Agreement or the Venue's instructions.
c) Technical issues with the Guest's mobile phone (e.g., low battery, no network, faulty hardware).
d) Items that are forgotten or not picked up.
e) Network or telecommunications failures beyond My Hangers' control.
f) Force majeure (cf. Section 9).
8. Right of Withdrawal
8.1. Under the Danish Consumer Contracts Act, the Guest generally has 14 days to withdraw from a purchase of services, provided the service is not fully performed. As cloakroom storage commences immediately upon check-in with the Guest's prior consent, the right of withdrawal ends once the cloakroom service has begun.
9. Force Majeure
9.1. My Hangers cannot be held liable for any failure or delay in fulfilling its obligations if such failure is due to circumstances beyond My Hangers' reasonable control, including (but not limited to) fire, flood, war, acts of terrorism, strikes, breakdowns in telecommunication, and similar force majeure events.
10. Personal Data
10.1. My Hangers may share necessary usage information with Venues the Guest visits if this is required to deliver the Services.
10.2. Personal data is processed in accordance with applicable data protection legislation (including the GDPR) and My Hangers' Privacy Policy.
11. Changes and Assignment
11.1. My Hangers may change these Terms and Conditions at any time, for example due to new legal requirements or modifications in the system. Any changes will be notified on the Website or via the app. By continuing to use the Services after changes, the Guest is considered to have accepted the new Terms and Conditions.
11.2. The current version of these Terms and Conditions is available at https://myhangers.dk.
12. Miscellaneous
12.1. These Terms and Conditions constitute the entire contractual basis between the Parties regarding the Services.
12.2. If a provision in these Terms and Conditions is found invalid or unenforceable, the remaining provisions will remain in force to the extent they can still be upheld.
